Lee, born 28 December 1976, faced prosecution by the Environment Agency under the Environmental Permitting (England and Wales) Regulations 2016 and the Environmental Protection Act 1990. He was convicted for:
- Operating a waste facility without the required permit
- Ignoring orders to remove illegally dumped waste
- Allowing controlled waste to be illegally burnt on site

The offending site sits just 1.2km from the Cotswolds Area of Outstanding Natural Beauty and only 0.7km from Wolford Wood, a Site of Special Scientific Interest. It lies near the busy A44 route connecting Chipping Norton and Moreton-in-Marsh, highlighting the risk posed to vulnerable natural spaces.
